The Code of Administrative Offenses of the Russian Federation provides for liability for such a violation in the form of a warning or a fine of 500 rubles (Article 12.20).

1. You see a traffic police crew in an ambush and warn other drivers by “blinking” your high beams. Such actions are not prohibited, since there is no direct prohibition on them in the traffic rules.

2. At night, when entering a populated area along a lighted road, you did not switch to the near one. For this, you will be reasonably held accountable, since the need to switch to a nearby vehicle is established by clause 19.2 of the traffic rules. If the road is not lit, you can continue driving with high beams.

3. During daylight hours, to indicate a vehicle on the road, you drive with front fog lights and also drive through a tunnel. As you exit, an inspector stops you. The punishment will be fair. Indeed, according to paragraph 19.4, fog lights can be used instead of low beams, while paragraph 19.1 speaks of the need to turn on high or low beam when driving through a tunnel.

By the way, the same situation occurs when driving with DRLs. When entering a tunnel, you need to turn on the low or high beam. You cannot drive through the tunnel with DRLs.

4. If you do not switch from high to low when driving oncoming in the dark, the punishment will be fair. Even if people you meet don’t ask you to do this, clause 19.1 of the traffic rules states the need to switch to the next one at least 150 meters from the oncoming car.

5. During the day in a populated area, you drive with high beam headlights. In this case, there is no violation, since there is only one direct ban on the use of high beams in a populated area - darkness and a lit road.

6. Driving around the city at night with DRLs will incur a fine. In this case, traffic regulations clearly require that either the low beam (if the road is lit) be turned on, or the high beam if there is no lighting in the populated area.

7. Currently, when driving during daylight hours, some categories of vehicles must turn on low beam headlights. This is evidenced by the paragraph:

19.5. When driving during daylight hours, in order to indicate a moving vehicle, the low beam headlights must be turned on:

  • on motorcycles and mopeds;
  • when moving in an organized transport convoy;
  • on route vehicles moving along a specially allocated lane towards the main flow of traffic;
  • at organized transportation groups of children;
  • when transporting dangerous, large and heavy cargo;
  • when towing motor vehicles (on a towing vehicle);
  • when driving outside populated areas.

Please note that the vehicles listed must use low beam headlights. However, this does not mean that other vehicles cannot do the same.

The use of fog lights is described in:

19.4.

  • in conditions of insufficient visibility, both separately and with low or high beam headlights;
  • instead of low beam headlights in the conditions provided for in paragraph 19.5 of the Rules.

Please note, fog lights can be used. Those. may or may not be used. Accordingly, even if your car is equipped with fog lights, you may never turn them on. Conversely, you can always drive with your fog lights on.

As for daytime running lights, the current version of the traffic rules does not talk about them at all. Well, since this type of lighting device turns on simultaneously with the car engine starting, there is no need to remember about it at all.

Let's summarize. Currently, during daylight hours, lights must be turned on only on vehicles listed in paragraph 19.5. Other vehicles can also turn them on as needed.

Use of lighting devices after November 20, 2010

After November 20, 2010, the text of paragraph 19.5 of the traffic rules will be significantly reduced, however, the group of vehicles that it will cover will increase significantly:

19.5. During daylight hours, all moving vehicles must have low-beam headlights or daytime running lights on to indicate them.

As for fog lights, paragraph 19.4 has undergone minor changes:

Therefore, fog lights are also an alternative to low beam.

Let's summarize. After November 20, 2010, each vehicle must have at least one of the following lights on: low beam, daytime running lights, fog lights.

Regarding car headlights and external lighting devices in general, it has not been introduced in our country for a long time. But just recently there was an alleged change in current traffic rules– low-beam headlights can now be left off in the daytime in Russia, at least in the summer. According to various sources, the new norms will come into force on April 1, 2018. Is it true? We have figured out all the changes to the Rules and other regulations!

What's happened?

In mid-March 2018, the network was overwhelmed with news that supposedly another change would come into force on April 1: the obligation to turn on headlights during the day in Russia was abolished. There are no references either to the initiators of the bill or to the official documents amending the traffic rules. And the news was spread mainly through Telegram and WhatsApp messengers.

According to the innovation, in our country, from April 1, there is no obligation to turn on headlights during daylight hours - specifically low beam and even daytime running lights. That is, something happened to clause 19.5 of the traffic rules, which reads:

during daylight hours on all moving vehicles for the purpose of marking them Low beam headlights or daytime running lights must be turned on.

According to various sources, new law has the following types:

  • According to the change, it is allowed not to turn on low beam headlights during the day only in the summer or snowless seasons - from April 1 to September 30 of each year. The reasoning is simple: in summer the daylight hours are much longer than in winter, therefore there is simply no need to use lighting devices;
  • You don’t have to turn on the low beams, but daytime running lights are definitely necessary - a strange statement, in fact, because today, even without changes to the traffic rules, this is prescribed;
  • In Russia, headlights on have been completely abolished during the daytime - that is, in any season on any car you can not use external lighting devices (except turn signals, of course) during the day.

This is true?

No. It is not true. Low beam headlights or DRLs still need to be turned on during daylight hours. No new laws regarding external lighting devices have been introduced either since April 1, 2018, or... even back in 2014. And changes specifically regarding light are not planned.

How can you prove it?

Everything is very simple. There are 2 possible "proofs".

Official publication of changes

Since the traffic rules are formally a by-law approved by a decree of the Russian Government, changes are introduced by the relevant resolutions. And it’s easy to prove that there were no changes regarding lighting devices, knowing how the regulations come into force:

  1. the resolution is introduced for discussion and adopted,
  2. further, the published change must be published on one of the official websites of legal information, and these are regulated by Presidential Decree No. 763 of May 23, 1996 on the procedure for the entry into force of legislative acts.

Paragraph 2 of this Decree tells us the following:

Revisions of traffic regulations

Another argument against changes in the Traffic Rules is the edition of the traffic rules. With each change, a new edition comes into force. Today, the most up-to-date database on them is contained on the Consultant Plus website. And here you will find 3 editions: one that entered into legal force on March 18, 2018, and 2 more that are pending.

But most importantly, none of them has in the list of changes section 19 of the traffic rules, which specifically concerns lighting devices.

  1. the edition, which came into force on March 18, made reflective vests mandatory,
  2. the second will take effect on April 28 and marks the appearance of waffle markings at intersections,
  3. the third – from July 1 and will regulate the environmental class of cars.

As you can see, no changes have been introduced to the traffic rules since April 1, 2018, and you still need to turn on your headlights during the day.

How should we use lighting devices today?

So, the traffic rules today regulate the following rules for the use of headlights.

Night time:

  • near and/or rear PTFs together with dimensions when parking on unlit sections of roads (it is not necessary to turn on the near ones, but the dimensions are required),
  • only on unlit roads and only together with a neighbor or a distant driver.

Insufficient visibility(fog, rain, etc.):

  • low or high beam (see below conditions when you cannot use high beam) when driving,

Daylight hours(any of the following):

  • Daytime Running Lights,
  • dipped headlights,

There is no need to turn on the taillights during the day.

Tunnels:

  • low or high beam (see below for conditions when high beam cannot be used).

When not to use high beam headlights:

  • on an illuminated road in populated areas,
  • closer than 150 meters from oncoming traffic,
  • further than 150 meters from the oncoming traffic, if the driver of the oncoming car blinks his headlights,
  • in any case where you may blind drivers.

Direct blinding of pedestrians by distant traffic regulations is not prohibited.

What is the fine if you drive during the day without headlights?

If you drive on December 24, 2019 without any light at all - regardless of whether it is low beam, DRLs or fog lights, then you will face a fine of 500 rubles. This is provided for by the only article in the Code of Administrative Offenses - 12.20, which provides for penalties for any violations of the use of lighting devices - be it the absence of light during the day or the failure to turn on turn signals during maneuvers.

Section 19 of the Rules and Section 3 of the List fully regulate the rules for the use of headlights, lanterns, sound signals and other lighting devices, as well as colors approved for use.

What color is allowed

The colors allowed by the Rules are specified in clause 3.6. List.

Front

In ab. 2 clause 3.6. The list says that the front of the car must be equipped with headlights that produce only:

  • white;
  • yellow;
  • or orange light.

Otherwise, operation of the vehicle is prohibited, and administrative proceedings are initiated against the driver (see below for possible sanctions).

Reflectors located at the front must only have White color, other shade is prohibited.

Low beam

In relation to low beam, the List does not establish separate ban. That is, low-beam headlights should only emit a white, yellow or orange tint, the rest are prohibited.

Similar requirements are defined for high beams, that is, the light bulb must emit white, orange or yellow color.

Behind

In ab. 3 clause 3.6. The list indicates what color the lighting devices installed at the rear of the vehicle should emit.

As a rule, two rear lights are installed on a car, which contain various blocks with light bulbs:

  • side lighting (the weakest in power);
  • fog light;
  • brake signal;
  • reverse;
  • turn signals.

The rear light compartment used to signal the start of reversing must emit only white light, otherwise operation of the motor vehicle is prohibited.

The same requirement applies to light bulbs illuminating the state register sign– they must also emit only a white tint – others are prohibited.

In other compartments of the rear light, the use of 3 colors is allowed:

  • red;
  • yellow;
  • or orange.

However, the List does not indicate that any signals should only be of a certain color.

This means that the turn signals can be red, yellow or orange. When using any of these colors the driver will be considered to have completed traffic rules requirements, and there will be no liability.

The same applies to the dimensions and brake lights - they can be yellow, orange or red.

In practice, it turned out that:

  • the dimensions have a red, not very bright light;
  • brake lights have a red tint (more pronounced than the side lights);
  • turn signals – yellow or orange;
  • the rear fog lights are the brightest red color (brighter than the side lights and brake lights).

Please also note that the reflectors at the rear can only be red.

Fog lights

Fog lights, as a rule, are an additional element of the vehicle and are not required for use according to the Rules.

In other words, if the car has additional headlights, the driver must use them in accordance with the established requirements; if they are not there, it’s okay, there will be no liability.

PTFs refer to front lighting devices. There are no special color requirements for “foglights”.

This means that PTF, like low and high beam headlights, should only have:

  • or white;
  • or yellow;
  • or orange.

Otherwise, the driver faces the same responsibility as for using low beam (high beam) headlights that do not meet the color requirements.

When do you need to turn on which headlights according to traffic regulations?

In Section 19 of the Rules, a citizen can obtain all the information he is interested in regarding the procedure for using lighting devices.

In the city

There are not many regulations in Section 19 of the Rules that regulate any differences in the use of headlights and lanterns in the city and outside it.

During the daytime

According to this article, sanctions may be as follows:

  • or a warning issued in writing in accordance with the regulations;
  • or a monetary penalty in the amount of 500 rubles, charged in accordance with.

As we noted above, for any violation of clause 19.1. – clause 19.11. Rules, the driver will incur one of the specified sanctions, that is, for, for example:

  • driving with fog lights at night (without low beams turned on);
  • failure to switch from high to low when an oncoming vehicle is at a distance of less than 150 meters;
  • driving during the day without the PTF or low beams on at all;
  • turning on the rear fog lights in any conditions except poor visibility, etc.

The traffic police inspector will have to decide what exactly to apply to the driver - a warning or a fine - immediately on the spot - when drawing up the resolution (). When choosing a sanction, the inspector must be guided by the requirements, and also take into account whether the driver has mitigating or aggravating circumstances (and).

If the inspector imposes a fine, it can be paid with a 50 percent discount if you make the payment within the first 20 days after the decision is made (Administrative Offenses Code).

These types of liability are valid in the event that the driver violates the rules for using headlights and lanterns. For non-compliance of lighting devices with established requirements, liability is much stricter.

For example, if the headlights emit a red light, the punishment will come according to the Code of Administrative Offences. The sanctions are as follows:

  • cancellation driver's license for a period of six months to 12 months;
  • + additional punishment in the form of confiscation of headlights that do not meet the requirements.

The same part says that exactly the same responsibility awaits those who install lighting devices with a color of lights or operating mode that does not comply with Section 3 of the List.

The legislator did not clearly indicate whether this provision applies only to the front ones or to the rear ones too (and why the red light devices were included in a separate formulation in the first place).

It seems that deprivation + confiscation also awaits those whose turn signals, parking lights and rear brake lights are a color other than red, yellow or orange (as well as those whose reverse lights are any color other than white).

In practice, deprivation usually awaits those who install xenon or headlights with a color that does not meet the requirements. Behind tail lights sanctions usually come under Part 1 of Art. 12.5. Code of Administrative Offenses – warning or penalty of 500 rubles. A novice driver may get confused about the legal requirements - what to turn on and when.
