Today, there is no penalty for using summer tires in winter, however, according to the technical regulations, for driving a car that does not meet road safety requirements, a driver can be fined for using bald tires (i.e. for not matching the tread). The penalty is provided for in Part 1 of Art. 12.5 of the Code of Administrative Offenses and is equal to 500 rubles.

Mandatory period for winter tires

The adopted law on studded tires caused a lot of questions and misunderstandings - when is it necessary to carry out seasonal change rubber in order to avoid the danger of prosecution and fines?

If we talk about the timing of replacing tires with winter tires, then the requirements in accordance with the text of the law in force, subject to amendments, are formulated as follows:

  • It is forbidden to use tires with anti-skid spikes in the summer;

  • According to the regulations, vehicles must be equipped with winter tires for a period of 3 winter months (from December 1 - March 1) and summer tires for a period of 3 months (June - August). Requirements for winter tires

  • It is forbidden to install on one axle of the car (front, middle, rear, etc.) winter tires that differ in pattern, design, model or type, degree of wear;
  • The motorist is obliged to ensure that all wheels of his vehicle have winter tires that meet the requirements. For example, if there are winter tires on three disks, and summer tires on one, such a violation is already equivalent to driving a vehicle without winter tires.

Separate points that are of interest to vehicle owners are whether it is possible to drive a car in the winter season on which the so-called “Velcro” or all-weather tires are used as tires. In the event that such tires, according to their technical parameters will meet the necessary requirements and will have the appropriate marking, then their use is not considered a violation.

It should be understood that driving on tires in winter that do not meet the requirements may be fraught with a fine of 500 rubles. Due to different climatic conditions in the territories where this technical regulation is in force, the terms of the prohibition of operation can be increased, but not reduced.

The terms of the prohibition of operation can be changed upwards by the regional government bodies of the states - members of the Customs Union.

In accordance with the Decree of the Government of the Russian Federation of July 15, 2013 N 588, from January 1, 2015, changes were made to the basic provisions for the admission of vehicles for operation. The new edition sets out paragraph 5.1 of the list of faults and conditions, under which the operation of vehicles is prohibited.

5.1. Tires cars have a residual tread depth of less than 1.6 mm, trucks- 1 mm, buses - 2 mm, motorcycles and mopeds - 0.8 mm.

Note. For trailers, standards for the residual height of the tire tread pattern are established, similar to the standards for tires of vehicles - tractors.

5.1. The remaining depth of the tire tread pattern (in the absence of wear indicators) is no more than:

  • for vehicles of categories L - 0.8 mm;
  • for vehicles of categories N2, N3, O3, O4 - 1 mm;
  • for vehicles of categories M1, N1, O1, O2 - 1.6 mm;
  • for vehicles of categories M2, M3 - 2 mm.

Residual tread depth of winter tires intended for operation on icy or snowy road surfaces, marked with a sign in the form of a mountain peak with three peaks and a snowflake inside it, as well as marked with signs "M + S", "M & S", "M S" ( in the absence of wear indicators), during operation on the specified coating is no more than 4 mm.

Note. The designation of the vehicle category in this paragraph is established in accordance with Appendix No. 1 to the technical regulation on the safety of wheeled vehicles, approved by Decree of the Government of the Russian Federation of September 10, 2009 No. 720.

Please note, in accordance with the requirements of the basic provisions for the admission of vehicles to operation there is no ban on the operation of vehicles under the conditions described in the technical regulation. That is, in accordance with this document, it is not forbidden to use summer tires in winter.

The new edition adds a requirement for residual depth pattern of winter tires, but there is no obligation to use them. However, the requirements of the main provisions for the admission of vehicles for operation do not cancel the requirements of the technical regulation.

A bill introducing fines for summer tires in winter and studded tires in summer is in State Duma under consideration and has not yet been adopted this year.

Every year, with the approach of cold weather, drivers begin to wonder when to put on winter tires. At present, the answer to this question is partly regulated by a regulatory legal document.

When is it legal to switch to winter tires?

So, what can be understood from this paragraph:

  1. During the summer months (June, July, August) Only studded tires must not be used.
  2. During the winter months (December, January, February) only winter tires are allowed. You can put both studded and non-studded tires on the car. The main thing is that they are marked "M + S", "M & S" or "M S" and the corresponding pattern (in the picture on the left).
  3. The terms of the prohibition of operation can only be extended by local authorities and cannot be reduced. Those. in your area, for example, studded tires may be banned from May to September. At the same time, regional authorities cannot reduce the term of the ban, i.e. From June to August, vehicles in all regions must not use studs.

Thus, there are the following intervals for the use of automotive rubber:

  • Summer tires(without M+S marking, etc.) can be used from March to November.
  • Winter studded tires(marked with M+S, etc.) can be used from September to May.
  • Winter studless tires(marked with M+S, etc.) can be used all year round.

Thus, if you have summer tires (without marking) and winter studded tires, then you must replace them during the fall, i.e. from September to November.

The reverse replacement of tires should be carried out during the spring, i.e. from March to May.

Use of all-season tires in 2017 and 2018

A separate group should be allocated to drivers using the so-called all-weather tires (intended for operation throughout the year).

All-weather tires can be used in the winter months (December-February) only if they are marked with the corresponding M+S, M&S or M S markings.

Otherwise, the operation of all-season tires in the winter months is not allowed.

Penalty for misuse of rubber in 2017 and 2018

In 2017 and 2018, Chapter 12 of the Code of Administrative Offenses does not contain references to the Technical Regulations of the Customs Union. Those. penalty for not having winter tires cannot be imposed. However, a draft of such a fine exists. You can learn more about it in this article.

However, there is fine for using worn winter tires- 500 rubles (or a warning). This fine may be imposed on a driver using winter tires (marked M + S, etc.), which have a tread depth at the most worn place of less than 4 mm. I note that a fine is imposed only when the vehicle is operated on an icy or snowy road surface.

The only law in force in Russia is TR CU 018/2011. The following conclusions can be drawn from it: summer tires are allowed to be used from the beginning of March to the end of November, winter tires with studs and the M + S marking - from the beginning of September to the end of May, winter tires without studs and marked M + S - all year round.

This means that from the beginning of June to the end of August it is forbidden to use tires with lugs, from the beginning of December to the end of February it is allowed to install winter tires without lugs and with lugs, if it has a pattern:

If you have tires for summer without lugs and markings, then you need to put them on from the beginning of March to the end of May. Try to replace summer tires with winter tires from the beginning of September to the end of November. The time intervals are long enough, when to change tires, decide depending on the weather conditions.

A separate type is all-weather tires. They can be used from the beginning of December to the end of February only if they have the M+S marking. If there is no marking, this rubber is not considered winter, that is, at the end of November, tires are replaced.

Local authorities have the right to change the terms of the ban on certain types of tires only upwards.

Draft Law No. 464241-6 was submitted on November 1, 2016 for revision to the Legislation Committee and the Transport Committee. For revision of the deputies was created working group. The Ministry of Internal Affairs gave recommendations on how to take into account the peculiarities of climatic conditions in different regions in order to agree on the timing of the use of studded tires. If the bill is passed soon, it will enter into force no earlier than September 1.

While there is no law on studded tires, traffic police officers should be guided by traffic rules. There were changes in the classification and a ban on the use of tires with worn tread was established.

Until March 24, 2017 (the release of Decree No. 333), no sanctions were provided for the absence of this sign. This document has included this sticker in the list of malfunctions that prohibit the operation of the vehicle. This is evidenced by changes in the following important document:

Based on this, the Code of Administrative Offenses from 04.04.2017 provides for a fine of 500 rubles for the absence of the “Ships” sign on the rear window. If the sticker is too small, it will not comply with the traffic rules.

What to do with the sticker in the summer is not clear. The law does not prohibit driving with it after changing wheels. There won't be a penalty for sure.

There are no fines for driving with wheels that do not correspond to the season, the punishment for low-quality tires is only 500 rubles. It's a small amount of money, but it's not the main one. “Bald” wheels very often cause accidents in winter. Your own safety is much more important than economy.
