Traffic police fines. What are the consequences of violating traffic rules? Current fines for non-compliance with traffic rules Fine 1600 for what it can be

The proposed material examines the main provisions of the administrative code regulating the issues of imposing and appealing traffic police fines, provides payment deadlines and statute of limitations for collecting fines for violations of traffic rules, and explains the consequences for non-payment of traffic police fines.

An administrative fine is one of the types of punishment provided for by the current Code of Administrative Offenses - the Code of Administrative Offenses of the Russian Federation. This type of punishment is widely used as the main and additional punishment for violations of traffic rules of the Russian Federation included in Chapter 12 of the Administrative Code.

The imposition of fines for traffic violations, in most cases, falls within the competence of traffic police officers, who identify facts of violations and make decisions on cases within their competence. In cases where the case is tried in court, the fine is imposed by the judge. For example, under parts of Article 12.8 - for actions of driving vehicles or allowing persons in a state of intoxication to drive them. The courts consider gross violations of traffic rules, for which penalties are provided in the form of deprivation of the right to drive, administrative arrest and, as an additional or alternative, an administrative fine.

Regardless of who imposes the traffic fine, its size is always limited by the limits (upper and lower) provided for by the articles of the Code of Administrative Offences. Unlike other violations provided for by the chapters of the administrative code, it is legally impossible to reduce the size of the traffic police fine imposed on an individual below the lowest limit.

The Code establishes a lower limit for traffic fines in cases of administrative offenses in the amount of less than five hundred rubles. Also, for any violation of traffic rules of the Russian Federation recorded by traffic police cameras operating in automatic mode, its owner is only given an administrative fine.

Details in the article:

  • How to appeal a traffic police fine based on video recording

Appealing a traffic police fine for violating traffic rules

Resolutions of traffic police officials on traffic fines are appealed according to the rules of Chapter 30 of the Code of Administrative Offenses of the Russian Federation. Two appeal procedures - extrajudicial and judicial - can be used at the discretion of the applicant. When first filing a complaint with a higher authority, if the results of the review do not satisfy the applicant, he has the right to go to court a second time. In this case, the decision on a fine made by the official and the decision on the complaint considered by his supervisor may be appealed to the court within ten days. We have described in detail the order and procedure for appealing decisions and cases of administrative offenses in the following articles:

  • Appealing the traffic police decision
  • Sample complaint against a traffic police resolution for violation of traffic rules of the Russian Federation

Until the court makes a decision based on the results of consideration of the repeated complaint, the decision to impose a fine is considered not to have entered into legal force. That is, the subject held accountable is not obliged to fulfill it. When appealing, accordingly, neither the period for paying the traffic police fine nor the statute of limitations for the execution of the punishment provided for by the Code of Administrative Offenses begins to run.

Deadline for paying traffic police fines for traffic violations

A fine for violating traffic rules issued by a traffic police officer must be paid within sixty days. The calculation of this period begins from the date of entry into force of the decision to impose punishment. The obligation to pay is assigned to the person in respect of whom the relevant decision was made.

If, after the decision is made, the person fined applies to the administrative body that made the decision with an application for an installment plan (deferment) of execution and his request is granted, then the deadline for paying the fine should be calculated from the date of the end of the installment plan (deferment).

In order to prevent delays in fulfilling the payment obligation, it is important to calculate the date the resolution enters into legal force.

So, if the legality and validity of the resolution is not disputed, then it comes into force after ten days following the date of delivery or receipt of a copy of the resolution by the citizen brought to justice (clause 1 of article 31.1, part 1 of article 30.3 of the Code of Administrative Offenses of the Russian Federation ).

The same period is given for appealing the decision made by the court and imposing the punishment, as well as for a complaint upheld during its first consideration. If the above acts were appealed to a higher court, and based on the results of its consideration, the complaint was rejected, then the resolution comes into force immediately after its decision is made by the last court (Clause 3 of Article 31.1 of the Code of Administrative Offenses of the Russian Federation).

Traffic fine with 50 percent discount

A progressive norm of administrative legislation that makes it possible to halve the size of a traffic fine imposed by the State Traffic Safety Inspectorate, from the point of view of the legislator, is: the possibility of paying the fine no later than 20 days from the date of its imposition. This rule does not apply to all traffic violations that carry a monetary penalty.

Exceptions to the offenses listed in Chapter 12 of the Administrative Code, which provide for a half-discount, that is, 50 percent, are:

  • driving motor vehicles (AMTS) subject to state registration and not registered in the prescribed manner, committed repeatedly (Article 12.1, Part 1.1);
  • traffic violations related to the transfer of control and driving a vehicle while intoxicated (Article 12.8);
  • violation of the speed limit by exceeding 40 to 60 km. /h. (Part 6, Article 12.9);
  • violation of the speed limit by exceeding more than 60 km. /ch., committed repeatedly (part 7 of article 12.9);
  • violation of traffic light rules when driving against a prohibiting signal, committed repeatedly (part 3 of article 12.12);
  • departure and movement along the oncoming lane of automatic transport vehicles and trams (part 5 of article 12.15);
  • moving towards the traffic flow along a road lane intended for one-way traffic of automatic vehicles (part 3.1 of article 12.16);
  • violations of traffic rules of the Russian Federation that resulted in harm to health and do not constitute a crime (Article 12.24);
  • refusal of the vehicle driver to undergo a medical examination, which does not constitute a crime (Article 12.26);
  • violation by the driver of the vehicle, participant in the accident, of the prohibition on the use of alcohol and other substances, as well as the use of such after stopping the vehicle before undergoing a medical examination (Part 3 of Article 12.27).

The key condition for applying a fine with a 50 percent discount is determining the moment from which the grace period begins. The start of the deadline for paying a fine for violating traffic rules with a 50 percent discount coincides with the date of the traffic police decision. Therefore, you can forget about appealing the discount decision, since the appeal procedure will take much more than 20 days.

At the same time, it is not prohibited to pay the fine in half and appeal the decision. If the traffic police fine was issued to the violator outside the twenty-day period, for example, due to unsatisfactory performance of the postal service, then there is no need to think about benefits. The same rule also applies to cases where the execution of the punishment was delayed or spread out at the request of the offender (Part 1, 1.3 of Article 32.2 of the Code of Administrative Offenses of the Russian Federation).

Statute of limitations for traffic police fines for traffic violations

The period during which a fine can be executed is two years. Its calculation begins from the date the resolution enters into legal force. However, you should not rejoice at those violators who, having demonstrated the art of resourcefulness, did not pay the administrative traffic fine. Evasion from execution of a monetary penalty by force of law interrupts the running of the two-year limitation period. In such cases, collection may last indefinitely. In this case, restrictions may be imposed on the debtor in the right to operate the automatic telephone exchange, his property may be arrested and forcibly sold, and the proceeds will be used to pay off the debt and enforcement fees.

Unfortunately, the law does not define the concept of “evasion.” What is meant by this term? It seems to us that evasion from fulfilling any obligation, by analogy with criminal law, should be understood as any deliberate actions of an obligated person carried out by him in order to avoid fulfilling obligations.
Thus, if the fine for traffic violations was not paid due to other circumstances not related to evasion, that is, not intentionally, for example, due to illness, then it makes no sense to pay the traffic police fine after the expiration of the pretrial period.

Responsibility for non-payment of traffic fines

If a violator of the Traffic Rules does not pay the fine within the prescribed period, then, starting from the day following the end of the two-month payment period, and over the next three months, he may be brought to administrative responsibility and given one of the penalties in the form of:

  • a fine in the amount of twice the amount of the unpaid fine, but not less than 1000 rubles;
  • administrative arrest for up to 15 days;
  • compulsory work for up to 50 hours.
  • Responsibility for failure to pay a traffic fine under Article 20.25 of the Code of Administrative Offenses of the Russian Federation

In conclusion of the article, we can only wish all drivers, passengers and pedestrians safe and comfortable road traffic and, of course, fewer traffic fines from the traffic police.

Along with the fine, you will receive access to photographs taken by means of automatic recording of violations. Unfortunately, sometimes there are cases where photographs are missing in the fines database. In this case, you need to contact the traffic police department that issued the fine, the name of the department is indicated in the detailed information on the page your unpaid traffic police fines.

In principle, there is no video of the violation; instead of a video, there will be a series of photographs.

When paying a fine, it is important to know:

  • Number of the protocol on the administrative offense (or the resolution on the case of the administrative offense if the protocol on the administrative offense was not drawn up);
  • The amount of the fine (including commission fees);
  • Details for enrollment (in banks and payment systems are determined automatically).

There is no need to provide a receipt for payment to the traffic police. In order not to carry the receipt with you and to avoid misunderstandings with bailiffs, it is preferable to transfer fines through banks, terminals and credit organizations with which the Ministry of Internal Affairs has entered into agreements on information exchange. In this case, when paying a fine, the information very quickly gets into the violation database. The fine must be paid within 30 days from the date the resolution comes into force.

Our service allows you to receive fines and pay them immediately. You need to understand that checking only on a driver’s license will only find those fines that were issued by the traffic police directly to the driver, and fines imposed by video recording will not be found.

Traffic police fines based on vehicle registration number

When checking only according to the state. With the vehicle registration number, you will only find fines issued by stationary means of automatically recording traffic violations, and fines issued by a traffic police officer to the driver of the vehicle will not be fully reflected.

It would be better to indicate all the data when searching for fines, this will allow you to find all the fines issued to you.

Traffic police fines - payment guarantee

After payment, in case of an error in the traffic police database, we will refund you the full amount of the fine and the amount of the commission.

To check traffic police fines, it is best to fill out complete data; this will allow you to find out about all the fines you have and will allow you to avoid unpleasant consequences in the future.

I don’t like MADI fines, fortunately I received them only three times, but two of them were associated with a huge payment problem. The MOS.RU and AUTOKOD systems see them, but cannot pay for them. The first time I couldn’t pay even through the savings bank, since “the receipt is not in the system”, I was able to pay only when a letter arrived from the bailiffs (fortunately their details were working). I was afraid it would turn out the same way this time. I came across “driver assistant” (I had never heard about this service from anyone I knew before), and it was scary to press the “pay” button. I was afraid I wouldn’t have enough nerves to wait 14 days, but fortunately in my case the payment went through in 2 days. Both MOS.RU and AUTOCODE show that the fine has been paid. I will tell my friends about your service. I really hope I don’t have to deal with MADI again.

Traffic police fines for traffic violations

Quite often it happens that we simply forget about the fines issued by the traffic police and the receipts received in the mail for violating traffic rules. It happens that we entrust the right to drive our car to another person and, in principle, cannot track whether he breaks the rules, whether there are traffic police fines for your car due to his fault, whether he pays the traffic police fines on time.

But if the protocol is drawn up and the traffic police fine database contains information on your violation, then sooner or later the state will take measures to collect your debt. Russian legislation establishes deadlines for paying a fine (this is 1 month), and provides for liability for non-payment of a fine to the traffic police. In accordance with Article 20.25 of the Code of Administrative Offenses, for late payment of a fine for violating traffic rules, you may be subject to a penalty - a fine of double the amount (but not less than 1000 rubles) or administrative arrest for up to 15 days.

Now many people are aware that traffic police fines that are not paid on time can become an obstacle when traveling abroad, buying and selling cars, and undergoing technical inspection. Therefore, checking traffic police fines is especially important in cases where you are about to undergo a technical inspection, you are planning to sell a car, or you are going on a trip abroad. After all, to do this, it is necessary to pay off all the debt on traffic police fines, if, of course, there is any.
